The US legal limit of .08% is pretty high, I don’t suggest driving at that point if it’s at all avoidable. That being said, it depends a good amount on your tolerance. 40oz is in between 3 and 4 (12 oz) beers. Personally, I have a pretty high tolerance and I can withstand 2 beers with no problem and I would probably still feel comfortable driving after 3 beers (entirely depending on how I felt though). After that though, I would certainly want time to sober up. Your body processes alcohol at about a rate of 1 drink an hour, so that means that after 4 drinks, I would want to wait at least an hour, probably a bit more to be safe. So for 40oz, I would wait at least an hour and then see how I felt. If you’re in a situation where you need to leave at a strict predetermined time then I wouldn’t drink as much, just in case I was having a bad day and didn’t want to drive right away. Otherwise, I’d give yourself at least an hour, probably 1.5 hours, and after that, possibly wait a bit more depending on how you feel. There’s no shame in waiting, but there is shame in drunk driving.
