  • Anything above 0.05 is considered alcoholic beer in the 50 States.

  • Every State has it’s own laws. In Georgia it was fairly recently upped from 9% to 14%. In Utah and Nebraska it’s quite a bit lower. Texas used to have two tax brackets for lower and higher ABV.

It’s not a federal law that governs the sale of alcoholic beverages. The states largely make up their own rules concerning alcohol.

Look up “Alcohol code (your state)” in google and you should be able to find the actual code.

  • Utah limits the beer sold in bars to 3.2%. After spending 2 years there, I can tell you that their beer is like making love in a canoe (old joke). IDK whether you can but real beer there if you go to the liquor stores (state run). Elsewhere, beer can be as strong as it can be fermented and not distilled.

  • 3.2% alcohol by weight or 4% by volume.
