Amended tax return and current tax return – can they be filed together?

If I’m amending a 28 return, and filing a 29 return, can they be submitted at the same time? Or will it slow things down even more?

I need to amend a 28 return to claim the homebuyer credit (I claimed half and received, need to claim the other half since my spouse isn’t – long story). Can I file the amended return and file the 29 return at the same time? What happens?

  • Same time – no problem, each year is treated separately. But don’t mail them in the same envelope.

  • The only way to “claim the other half” of the FTHBC is if either you weren’t married at the time you bought the house (in which case, yeah, either one of you could have claimed 1% due to incredibly lax rules) or if you were married, you update to a joint return.

    If you are expecting a large refund on the 29 return, you might want to wait until after it’s filed in January to submit the 1040x. The IRS merely logs in 1040X forms. It does not stamp it with probably a refund vs. probably owes. if the 1040x is outstanding at the time you file 29 (and it will be, the FTHBC takes 4-5 months), your 29 refund will be delayed until both are finished.

  • Send them in separate envelopes. Filing “together” is likely to confuse things at the IRS.
