i was driving my 49cc MOPED without my license, and just got my license 2 weeks ago. Yesterday i recieved a 1 year suspension for driving without a license. I had a warning when i had gotten caught the first time, and this second time being caught he ( being the officer ) gave me a ticket. He clearly stated and this is my word over his, ” Brad, if you pay this ticket you dont have to go to court and of you pay the ticket there will be no further penalties”. Well according to the notice i recieved in the mail he was wrong. Im not saying its his fault that i drove my moped without a license im just saying he should have been more specific with explaining your license will be suspended. The reason i was on my moped after being given the warning was to pick up my friend, who was riding his moped and his tire popped, so i had to drive him to the high school and that is where the school cop had caught me. I was wondering if there is anyway i could fight this suspension in court or through the DMV, i had a talk with the school cop today, he seemed to be on my side when i told him about the 1 year suspenison i had recieved and i asked him if he could write me like a “note” or something explaining the situation that occured and i could show the DMV. He said he couldnt do that but if it comes down to it he will CALL the DMV, explaining what happened.
So, i was wondering if i could fight this at court or at the DMV, and is it worth getting an attorney over * which i will if i have to.
