I paid for cobra, company is refusing to reinstate me to plan?!!?

if company takes my money isn’t that a)theft and b) an outright refusal to reinstate me to the health insurance policy which I’m federally eligible for?

What are my options and does the eeoc take care of this type of thing? Not sure why company would deny me such a thing, especially since it was originally offered when I left.

  • Here is some more information about COBRA.

    – you have 60 days to elect COBRA. If you miss the deadline, you miss the deadline. If you paid, you should be reimbursed. If this is the case, you need to ask your former employer or their cobra money was not reimbursed.

    – you have to pay COBRA every month, if you pay one month but don’t pay the next, you would not get reimbursed for the first month, but the 2nd month insurance would be cancelled.

    – once COBRA is rightfully cancelled by either physically cancelling it or failure to pay, it cannot be reinstated unless there was an error made.

    The Federal Department of Labor monitors COBRA for private companies and the Department of Health and Human Services monitors COBRA for the public sector.

  • EEOC deals with things that involve treating employees differently from each other because of their race, gender, religion, etc. If you have no reason to believe that the company did not do the same thing to everyone, then EEOC can’t help.

    There is another agency in the federal Department of Labor that deals with COBRA issues. You have to contact them, not EEOC.

    You can’t get “reinstated”. If you didn’t make the payment so it was RECEIVED in the timeframe required by law, you dawdled too long, and you’ve screwed yourself.

    Call them. They’ll TELL you why they refused you. Some options are: 1. it was too late 2. You had previously declined it (you can’t change your mind) or 3. you didn’t send in enough money.
