  • The taxes must be personal (1040, 1040A or 1040EZ) and not business. Unpaid trust fund taxes such as for payroll can never be discharged.

    The tax bill must have been assessed at least 3 years ago. If you filed late or not at all, the clock didn’t start.

    You must have given the IRS opportunity to try and collect. Stalling tactics (CNC, OIC) do not toll the clock.
