Is he liable when they Don't have his name?

A friend of mine received a letter from the city of los angles; stating that they needed to pay a fine to the city for illegal posting on public property (flyers). Apparently someone put flyers on light poles without his knowledge and the fine is for $419.. He could probably fight it the problem is that it is addressed to the wrong person and has a wrong address and the business name is not quite right either. The only way that he found out is that the next door neighbor of the business brought it over. What is the best way to go about fighting something like this? Should he just ignore it; they don’t even have his name on the bill?

    It sounds like your friend has been FRAMED.

    Someone else has been posting these “fake flyers” all over town in an effort to get your friend into trouble. How can people be so cruel?

    Well, it’s water under the bridge at this point. Nothing we can do about that. Hope next time they catch the culprit “red handed.”

    I noticed another poster (who’s name we will not mention) suggested your friend would have to PROVE he did not put the fliers up. This is INCORRECT. (And it is impossible to prove a negative.)

    The burden of proof would be on the other side. His accuser has the burden of proof beyond a reasonable doubt.

  • He’ll have to go to court and prove that those aren’t his fliers for his business.
