Is it legal for a restaurant to require its servers to not only solicit but receive a guest survey?

I work for a corporate restaurant and they have told us that if we do not get a guest survey a week (the kind that print out on the checks) that they will not be giving us the good shifts, only the top ten in the store. I cant force my table to do the survey, and they fired a girl because they tracked her surveys to the same computer, so cheating is not an option. I cant afford to lose any money over this, and I cant beleive that they should be able to get away with this kind of threat. If we got a bad one, and they punished us, I could understand. But just because my table wont do the survey, I shouldnt lose my shifts.

wow, so they can fire me beause I couldnt make my table go home and take their online survey? That seems like such an unlawful practice. I mean, the guest survey doesnt affect how good or bad I am doing my job. Guess its time to find a new restaurant to wait tables at lol

    YES

    the whole point is you don’t need to force the table, politely and professionally let each table know about the survey, and politely ask them to help you and the restaurant to improve by taking the survey…. do NOT mention that you are required to do this or that this will affect you negatively in any way, stay upbeat and positive, make sure they understand that you sincerely care about what they think and the company really wants their input.

    it is all a matter of how you “sell” this just like up selling or suggesting a desert………

  • They can schedule staff however they want to, so yes they could cut your shifts or not give you good ones, or even fire you if they wanted to.

    They’re only asking for at least one a week? That shouldn’t be all that hard. If a server who had done a good job said to me when they gave me the check “I’d really appreciate it if you’d do the survey printed on the check – it’s really important to me”, I’d do it. How many tables do you serve in a typical week?

  • they pay you they make the rules, as it is company policy it is neither legal or illegal just policy, they could even fire you if you do not comply
