Is it my responsibility to cut down broken tree branches from my tree that are hanging in my neighbors yard?

We had a bad storm and many branches fell from our tree. We did most of the cleanup ourselves but there are two broken branches that we were unable to get because they are hanging over our neighbors yard. Are we responsible if they fall and do damage or should they cut them down since they are over their property?

*We are first time homeowners and are new to these problems.

  • Yes, it is your responsibility either to remove them or have a tree service do so. If they fall and injure someone or do property damage, that took, is your responsibility.

    Make sure your neighbors are aware that you or a service will be in their yard to remove the offending branches.

    As you become homeowners longer, you will learn more of the joys of homeownership.

  • same thing happened to us, i believe if they hang on your neighbors side they should take it down and you wont be responsible. If it hits a part of their fence or house, i believe their home insurance will cover it but not if it just drops in their yard. I would have someone come over and just tidy up the whole tree, im sure the neighbors will let the guys go in their yard to tidy it up. Then everyones happy.

  • No you are not because the branches were damaged due to “an act of God”, i.e. a storm. If they had just rotted off, that would be your responsibility. I learned this because of having a similar situation on a piece of property I owned.

  • you must have permission to enter the neighbor’s property, first…. so talk to them and offer to cut down the broken limbs and get rid of the cuttings ….. then if they say they’ll do it, say thank you and offer to take the wood that they cut off…. it’s yours, after all and they should return it to you…. you cannot enter their property without their okay, so get it first…. and yes, it’s your responsibility to take care of any problem from YOUR tree!….take this chance to trim that tree up as it should be…. off the other guys property line….

  • If it is your tree, then yes you are responsible. In the future you could try trimming your tree so as no branches cross over into your neighbors yard.

    That being said, if there are that many dead limbs and the tree is that problematic you should have the whole thing taken down.

  • Yes, it is. The neighbor is also allowed to hire someone to cut them and send you the bill. That is the law.
