Custody of baby cousin?

Can someone please help me! My cousins baby was taken away from CPS, unfortunately her rights have been terminated every child she has will be taken away due to her being unstable. Her second kid was given to the grandfather, my uncle but he put up a good fight, the baby girl which was recently born not long ago was taken away, unfortunately my uncle is not and cannot handle one more kid for he has the first two kids. I am 18 years old , I’m working two jobs and going to school. I also live with my mom so she would be able to help out. I’m getting married in December too. What are the chances of me getting my baby cousin, and where do I start. Someone please help and don’t answer With any rude comments.

I live in Florida however the baby is in Oregon. I work as a server and make about $150 in 4 hours plus i get paid two times a month. I have taken childcare classes and have worked as a childcare provider

  • You say you live with your mom, so your mom is also related to your cousin. She may have greater chances of getting guardianship of the baby than you. Go for it, CPS often give precedence to family members.

  • It is highly unlikely. You are not an immediate family member of the child (parent, sibling, grandparent), you are young, how would you have the time to care for the child?

    You also are not stable, as in you do not have your own home (if the child is put in your custody, it is YOUR custody not the custody of your mother). Can YOU afford the housing, medical expenses, clothing, education expenses, of the child?

    I am not saying it is impossible, but it is highly unlikely. If her rights have been terminated then she will likely go to a home that has already been approved for foster and/or adoption until a permanent home is found if no immediate family members can take her.

    Also, it is never true that “every child she has will be taken away”. A child can only be removed if abused, neglected, in a harmful situation, etc. THey can not take a chlid away because of past mistakes. If your cosin were to straighten up she could keep her future children.

  • Krystal, it’s wonderful of you to even consider such a task! You sound like a very amazing loving person to even pose this question. Caring for a baby is a huge commitment for anyone, and in your situation at only 18 with two jobs, a wedding coming up AND school ~ that seems overwhelming. Are you sure there are not better options for both you and the baby? This situation reminds me of on an airplane when the oxygen masks drop, you’re supposed to put your own on first, then put it on your child… because you can’t help another well if you’re incapacitated yourself. I wish you the best, girl, and hugs to you for your tremendous concern for this baby.

  • You won’t find out on this forum. Call the child’s caseworker in Oregon and find out if you have a chance. Get the court case number and make sure you get a letter on file so the judge knows there is a willing relative, albeit a stranger, available for placement.

  • Relatives usually have first preference. You should contect CPS in Oregan and just talk with someone. Also, contact Legal Services in Oregan and in your state. They can give you free legal advice.
