How negotiable are settlement offers after your job offer has been revoked?

My job offer was revoked after I resigned from my employer. The recruiting dept. made a mistake and overlooked that I disclosed in my application that I was terminated from their affiliate back in 2005. After going through the interview process, they realized their mistake but had to revoke their offer. In consideration of their mistake, they offered a settlement comparable to 1 month pay. Although very unrealistic, how negotiable is this offer?

  • The employer wants to settle with you for less than you would get in court. Since you disclosed your termination in your application and since you resigned in order to take the job they offered you, you are entitled to some compensation for what you have lost (your previous job). It is somewhat negotiable. You could talk with an employment law attorney about your situation. You want one who represents employees rather than employers. Also, be sure that the attorney won’t charge for the initial consultation. It would help you make a good decision if you knew how much you would probably get in court.

  • They don’t have to offer you ANYthing, so depends on how bad they feel about the situation.

  • what?? you can’t negotiate that. if you are in the states–they can hire and fire you for any reason. be glad you are getting anything
