Unless you get permission from original author you can not use copyrighted items. What could happen read text copied from Google and use url link for full details.
Regrading tracing and utting you in the jail? that is why youtube got warning system as you can read below. But now a days we can not say for sure what could happen. Better be safe right?

As long as you don’t put your own watermark in it!
You may upload it as it is(this is not illegal and therefore not punishable).
But,if you take the credits to yourself or erase the original credits(eg.like erasing the channel’s name or logo,or erasing the website’s name or logo from the video),then you may get punished,as it is illegal.
In simple words,YOU MAY UPLOAD THE VIDEO AS IT IS(ie-the original video you have,without making any changes).
