What's the difference between adoption and just signing the birth certificate?

me and my girlfriend have decided that we want her on my daughters birth certificate . my daughters father is not on it or around at this point. so can she adopt her also or is her just signing the birth certificate pretty much the same thing? and how would we go about doing all that?

  • Adoption is legally making an adult the parent of the child. Signing a birth certificate of a child that isn’t yours is fraud as birth certificates are documents stating who the natural parents are. If your girlfriend signs the birth certificate it is falsifying it therefore illegal.

  • The original birth certificate is supposed to show 1) either the actual biological parents, 2) the biological mother only, if she’s unmarried (depending on state law), or 3) the biological mother and the man to whom she was married at the time of the birth (the baby’s presumed legal father). Signing any other name is fraud.

    If the baby is adopted, a new, amended birth certificate will be issued to show the adopting stepparent’s name. I don’t know how this is handled for a same-sex couple in a state where same-sex marriages aren’t legal, but a local attorney can advise you.

    If you allow your daughter to be adopted, make sure you get a copy of the original birth certificate first. Keep it in a safe place. Your daughter may need or want it some day.
