Who decides who can sell crown land?

Queen Elizabeth ii minds the crown land and can’t sell it. So if some crown land was to be sold who does the money go to? The Queen or the government? If the land is rented then who earns the income? Why is the Queen allowed to own it and no one else? What about indigenous people who lived on the land before the UK crown claimed it?

  • In Australia, it was considered by the High Court of Australia in Mabo vs Queensland.

The easy wikipedia reference is at : http://en.wikipedia.org/wiki/Mabo_v_Quee…

But the full implications are very complicated indeed. Essentially, it gives traditional owners rights and substantially dilutes the rights of the Crown.

  • To the government. It’s called “Crown Land” or (in Canada) a “Crown Corporation”, but that’s just a name – the Queen has nothing to do with it.

  • The land is leased. The Crown technically controls it but in reality it is the government. The Queen draws from the Crown Estate like water from a well, but she cannot sell the well to anyone else and the ‘water’ can only be used to compensate working costs. The entirety of the income belongs to the Crown but 85 per cent is given to the government and the Queen is given 15% to cover expenses.

‘Indigenous’ British peoples are different from those in other places like Australia or America. They are part of society and were not forced out or robbed in recent years, and they do not retain ancient culture for the most part. The lands were almost always controlled by lords and then absorbed by the Crown after criminal proceedings or when nobility became royalty. There’s no one to give compensation to.

  • The Crown can sell it (or give it away – in Canada, you can make “an application for a grant of Crown land.”

The Crown is essentially the Government in reality. The Queen does not own it personally, but, does as the human face of the Crown. Crown things are generally administered by Government, which is part of the Crown.

  • The government. The Crown Estates revenue goes to the MONARCHICAL GOVERNMENT for use of the sitting monarch’s government works–official work expenses are what the revenues are used for–the UK monarchy pays for itself. If the monarchy no longer existed, Parliament would decide where Crown Estate money would go to; it is possible that the royals be allowed to keep Duchy of Lancaster holdings only if Parliament approves. A deal would be struck, possibly, to allow this.
